Introduction
Welcome to Maintained Mind. These Terms & Conditions govern your use of our website, services, and membership. By accessing or using Maintained Mind, you agree to be bound by these terms. If you do not agree, please do not use our services.
User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information during registration.
- Maintain the confidentiality of your account credentials.
- Notify us immediately of any unauthorised use of your account.
- Be at least 18 years old, or have parental consent if under 18.
Acceptable Use
You agree to use Maintained Mind in a respectful, constructive, and collaborative manner. You explicitly agree not to use Maintained Mind to:
- Upload or share harmful, abusive, or illegal content.
- Harass, abuse, or harm other members or facilitators.
- Attempt to gain unauthorised access to our systems.
- Share session links or resources with non-members.
- Use the platform for any commercial purpose without permission.
Membership & Payments
Membership is provided on an annual basis. At checkout, GoCardless takes a one-off instant bank payment for your first year (Instant Bank Pay) and, in the same flow, sets up a Direct Debit mandate so future yearly renewals are collected automatically on the anniversary of your sign-up. If your bank does not support instant payments, your first payment is taken via standard Direct Debit instead (3 to 5 working days). Fees are as displayed at checkout. By completing checkout you authorise GoCardless to collect the first payment and future renewal payments in accordance with your mandate. Membership fees are non-refundable outside the statutory 14-day cooling-off period.
Live Sessions & Availability
Live group sessions (including weekly restful body-doubling and fortnightly solution-focused check-ins) are scheduled regularly but are subject to practitioner availability. Sessions exclude scheduled annual leave, UK bank holidays, and short-notice sickness or unforeseen circumstances. Where a session is cancelled or rescheduled, members will be notified by email and via the member dashboard as soon as reasonably possible. All session times are shown in UK time (GMT/BST). Recordings are not guaranteed and may not be provided for every session. Occasional schedule changes do not entitle members to a refund of annual membership fees outside the cooling-off period set out in our Cancellation Policy.
Intellectual Property
All content, materials, and resources provided through Maintained Mind are owned by or licensed to us and are protected by copyright and other intellectual property laws. You may use these materials for personal, non-commercial purposes only. You may not reproduce, distribute, or create derivative works without written permission.
Medical & Mental Health Disclaimer
Important Notice
Maintained Mind provides a platform for peer support, community accountability, and general mental wellbeing maintenance. It is not a provider of clinical therapy, psychiatric diagnosis, or medical treatment.
By using this service and participating in our live sessions (including body-doubling and solution-focused check-ins), you acknowledge and agree that:
- No Advice: Any content, resources, or discussions held during live sessions or on the platform are for educational and peer-support purposes only and do not constitute professional medical or psychological advice.
- No Clinical Relationship: Participation does not establish a therapist-client or clinical practitioner relationship between you and Maintained Mind or its facilitators. For one-to-one clinical therapy with Kim Clayden, please visit online-psychotherapist.com.
- Assumption of Risk: You are fully responsible for your own mental health and well-being. Maintained Mind assumes no liability for decisions made or distress experienced based on platform interactions.
- Not a Crisis Service: Maintained Mind does not provide emergency intervention. If you are experiencing a mental health crisis or thoughts of self-harm, please immediately contact emergency services (999/111) or call the Samaritans on 116 123.
Limitation of Liability
To the fullest extent permitted by law, Maintained Mind and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for membership in the 12 months preceding the claim.
Termination
We may suspend or terminate your account if you breach these terms or engage in conduct that harms the community, or fail to maintain a respectful attitude toward other members or facilitators. You may cancel your membership at any time via your dashboard. Upon termination, your access to sessions and resources will cease at the end of your paid term.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms
We may update these Terms & Conditions from time to time. We will notify members of material changes by email or via the dashboard. Continued use of the service after changes constitutes acceptance of the revised terms.
